Terms of Reference

1. Requesting Office (hiring entity): UNHCR Office in Paris (CO PARIS)
2. a.Title of project: Training of members of legal professions and any other profession dealing with refugee rights

b.Purpose of project: Establish a pool of consultant trainers to support UNHCR Paris. Trainers will work in coordination with the Protection Unit of the Paris Office. Their legal and/or geopolitical expertise will help strengthen understanding of asylum procedures and cases. Trainings will be delivered in person or virtually, accompanied by written materials.

3. Duration and dates of the assignment: This roster will be open for several years, and reviewed periodically.


The individual contractor(s) will be engaged on a retainer type of contract on a flexible working schedule. The specific scope and workload will be determined on an ongoing basis according to the needs of the requesting UNHCR operation who will issue specific terms of reference for each mission. These will specify the duration of the engagement, maximum number of working days and amount payable to the contractor.

Retained candidates will be required to complete all UNHCR’s mandatory trainings which are, at the time these ToR are issued, as follows:
• BSAFE (security)
• Fundamentals of Fraud and Corruption Awareness
• Information Security Awareness Training
• Prevention of Sexual Assault and Abuse
• Protection Induction Programme
• United Nations Course on Prevention of Harassment, Sexual Harassment and Abuse of Authority.

Working hours are NOT applicable. The total number of days/weeks/months to be worked will be defined in the mission ToR issued when the need arises.

4. Location(s): Working from home or in person depending on need.
5. Assignment and/or mission travel is not applicable for this role.
6. Suggested fee (daily/weekly/monthly/lump sum) and currency:
Each mission will be remunerated EUR 250 per day, payment to be made at the end of the mission upon completion of service, submission of attendance sheet and performance evaluation.

7. General Background of Project or Assignment:
This initiative is part of UNHCR’s support to the National Court of Asylum (CNDA), in accordance with Article L.732-1 of the Code on the Entry and Residence of Foreigners and the Right of Asylum (CESEDA), as amended by the law of 26 January 2024.
From now on, qualified individuals serving as assessors in the CNDA’s collegiate panels are appointed by the Vice-President of the Council of State upon proposal by UNHCR, which is responsible for their recruitment and training.

The agreement signed on 12 December 2024 between CNDA and UNHCR, pursuant to the 2008 framework agreement between UNHCR and the French Republic, provides that UNHCR organizes joint training sessions with judges.
These trainings will be extended to other members of legal professions and any other profession dealing with refugee rights.

Service will be requested on a needs basis and will include below activities and deliverables:

Activities:
- Prepare and deliver training sessions for members of legal professions and any other profession dealing with refugee rights.
- Develop written training materials
- Provide relevant legal and/or geopolitical expertise

Deliverables:
- Training sessions conducted as per agreed schedule
- Written training materials submitted

Performance will be achieved when above stated activities are implemented (timesheets to be provided), and deliverables confirmed delivered by the supervisor.

Qualification and experience required :
- Advanced university degree in law, international law, or related field
- Specialization in refugee law and human rights law
- 8 years of experience in asylum field, refugee law, human rights, international relations, administrative law, and other relevant judicial or geopolitics fields, including drafting and analysing judicial decisions
- Experience as a trainer
- Knowledge of the French and EU asylum system
- CEFR C2 level in French

11. Monitoring and Progress Controls :
Training sessions are effectively conducted, written material is submitted.

NB/ This position is part of a roster of legal trainers, meaning selected candidates will be included in a list of qualified professionals who may be called upon to deliver training sessions as needed.
